Terms of Service

These Terms of Service (“Terms”) govern your use of the Atlas Onsite platform operated by Atlas Onsite, Inc. ( “we,” “us,” or “Company”). By creating an account or using the service, you agree to these Terms. If you are using the service on behalf of a business, you represent that you have authority to bind that business to these Terms.
1. The Service
Atlas Onsite is a cloud-based field service management platform that provides scheduling, dispatch, job management, client and property management, mobile field workflows, form and photo documentation, rate sheet management, and related business tools. The service is provided as software-as-a-service (SaaS) and is accessed through a web browser. No software download or installation is required.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the service. The service is intended for use by businesses operating in the United States.
3. Account Registration
To use the service, you must create an account and provide accurate, complete information including your name, email address, company name, and business type. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@atlasonsite.com if you become aware of any unauthorized use of your account.
The account owner (the person who created the account and is responsible for billing) may invite additional users and assign roles that control access to features and data within the platform. The account owner is responsible for the actions of all users they invite.
4. Subscription and Billing
Atlas Onsite offers subscription plans billed monthly or annually. Pricing, plan features, and user limits are described on our Pricing page. All prices are in US dollars and exclude applicable taxes.
- Free trial. New accounts receive a 14-day free trial with full Business Pro-tier access. No credit card is required to start a trial.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annually) at the then-current rate unless cancelled before the renewal date.
- Cancellation. You may cancel your subscription at any time from your account settings or by contacting support@atlasonsite.com. Cancellation takes effect at the end of the current billing period. You will retain access to the service until your paid period ends.
- Refunds. Monthly subscriptions are non-refundable. Annual subscriptions cancelled within the first 30 days are eligible for a full refund. After 30 days, annual subscriptions are non-refundable but remain active through the end of the paid term.
- Price changes. We may change subscription pricing with at least 30 days' notice. Price changes take effect at the start of your next billing period after the notice period.
- Failed payments. If a payment fails, we will attempt to notify you and retry the charge. If payment is not resolved within 14 days, we may suspend access to the service until the balance is paid.
5. Your Data
You own your data. All business data you and your team enter into the platform — including client records, contacts, properties, jobs, visits, invoices, payments, time cards, notes, form responses, photos, and documents — belongs to you. We do not claim ownership of your data.
You grant us a limited, non-exclusive license to use your data solely for the purpose of providing and operating the service. This includes storing, processing, transmitting, and displaying your data to you and your authorized users. We will not use your business data for marketing, sell it to third parties, or share it with other customers.
We may use aggregated, anonymized usage data (such as feature usage patterns and system performance metrics) to improve the service. This data cannot be used to identify you or your business.
Data export. You may request an export of your data at any time by contacting support@atlasonsite.com. We will provide your data in a standard format (such as CSV or JSON) within a reasonable timeframe.
6. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable law or regulation
- Upload or transmit content that is harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
- Attempt to gain unauthorized access to the service, other accounts, or the systems and networks connected to the service
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the service
- Resell, sublicense, or make the service available to third parties as a service bureau or similar offering
- Interfere with or disrupt the service or servers and networks connected to the service
- Use automated scripts, bots, or scrapers to access or extract data from the service
- Upload malware, viruses, or any code designed to disrupt or damage the service
We reserve the right to suspend or terminate your account if you violate these terms. We will make reasonable efforts to notify you before taking action, except where immediate action is required to protect the service or other users.
7. Intellectual Property
The Atlas Onsite service, including its design, code, features, documentation, branding, and all related intellectual property, is owned by Atlas Onsite, Inc. and protected by copyright, trademark, and other applicable laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the service as described in these Terms.
We grant you a non-exclusive, non-transferable, revocable license to access and use the service for your internal business purposes during your active subscription. This license terminates when your subscription ends or your account is closed.
8. Third-Party Services
The service integrates with third-party providers for infrastructure, email delivery, file storage, and document processing (as described in our Privacy Policy). We are not responsible for the availability or performance of third-party services. Your use of third-party services may be subject to their own terms and privacy policies.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted, error-free, or secure access to the service. Scheduled maintenance will be communicated in advance when possible. We may modify, suspend, or discontinue features of the service at any time. If we discontinue the service entirely, we will provide at least 90 days' notice and assist with data export.
10. Disclaimer of Warranties
The service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will meet your specific requirements, that the service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Atlas Onsite, Inc., its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the service, regardless of the theory of liability.
Our total cumulative liability to you for all claims arising out of or related to these terms or the service shall not exceed the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Atlas Onsite, Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service, (b) your violation of these Terms, (c) your violation of any rights of a third party, or (d) any content you upload or submit through the service.
13. Termination
By you. You may close your account at any time by contacting us. See Section 4 for billing implications.
By us. We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent or illegal activity, fail to pay fees after notice, or if required by law. For other reasons, we will provide reasonable notice before termination.
Effect of termination. Upon termination, your right to use the service ceases. Your data will remain accessible for 90 days after termination so you can export it. After 90 days, we may delete your data. You may request earlier deletion by contacting us. Sections 5, 7, 10, 11, 12, 14, and 15 survive termination.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the service shall be resolved in the state or federal courts located in Washington State. You consent to the personal jurisdiction of these courts.
Before initiating any formal proceeding, you agree to contact us at support@atlasonsite.com and attempt to resolve the dispute informally for at least 30 days.
15. General Provisions
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Atlas Onsite, Inc. regarding the service.
- Changes to these Terms. We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform at least 30 days before the changes take effect. Continued use of the service after changes are effective constitutes acceptance.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force majeure. We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, power outages, network failures, or government actions.
